Yes, digital image (digital TV) is considered differently under the rules.
An STA would be the way to get an experimental group to prove it out and
then submit a report and proposal.
Though 33 cm doesn't have this limitation and the chip used in the design
should support it.

Why can digital ATV get away with it and we cannot? Their data rates get up
to mbps. They justify it by calling it "TV" rather than data.
